Your Honor, FIRST, it is clear that Atty. Raul
Quiroz admitted that SHELL business is profitable

"16. While the company, as a whole is still profitable,

by the Company but also by its competitors
who are engaged in the refinery business.
In fact, judicial notice may be taken of the
shutdown by one of its competitors, Caltex
Philippines, Inc. of its entire refinery
business in San Pascual, Batangas.

one of its process unit to sustain its refinery
business and to reorganize the company."

To continue on No. 16, Atty. Raul Quiroz wrote
though the company earns in totality, the company
is having difficulties in its refinery business, due to
one among so many, the reduced tariff rates of
imported petroleum products brought about by the
deregulation of the oil industry. Atty. Raul Quiroz
stressed that the reduction of tariff duties on the
imported petroleum products is causing financial
difficulties to the whole refinery business of SHELL
and not just to one plant alone.
But why close just one plant alone and not the
whole refinery business? Why would SHELL
continue with her refinery business while under
continuing difficult condition? It is worth to point out
that the reduction of the tariff rates on imported
petroleum products brought about by the deregulation
of the OIL INDUSTRY still persists even with the
closure of one plant. The closure of one plant did not
alter the scenario. It did not help increase back the
tariff rates for imported petroleum product nor solve
the problem. The problem remains.
Hence, it is highly questionable that the company
would still continue with her refinery business in
such worse predicament. If it is true that the
company is having difficult financial condition
with her refinery operations due to reduced tariff rates
of imported petroleum products it would have opted
to close all refinery operations all the while, and not
closed just one plant alone and just simply
import finished petroleum products?

Your Honor, please, may I be allowed to present
to you an analogy. I would compare this scenario
to an incident where, SHELL, example of a person's
name, went to see a movie. SHELL told you, as
you converse with him, that the movie is no good to
watch. He told you that he saw CALTEX, another
movie goer, went out because the movie is real bad,
without even asking CALTEX, the real reason why
he left.
Then, SHELL resumed with his story. He stressed
that the movie was real bad that what he did is,
he just cover his right eye with his right hand and
continued watching the movie.
Would you believe him that the movie is real
bad to watch? You most probably tell SHELL,
"You fool why stay and kept watching?"

Your Honor, please, now we go to the subject
DEREGULATION OF THE OIL INDUSTRY which
as per Atty. Raul Quiroz sworn statements gave
SHELL financial or economic difficulties that lead
employment of employees is deceitful lie.
On the contrary, the OIL DEREGULATION LAW
serve the business interests of those involve in
oil industry. We can see that in every increase
on the costs of doing business like the increase
of price of crude in the world market, they could
immediately raise the price of their petroleum
products locally without restraint. By virtue of
this law, they could dictate the price of petroleum
products as much as they want without government
intervention. They were accorded the prerogative to
set prices of petroleum products to insure windfall
profit or to insure returns enough to recover loses,
when there might be.
In other words, the OIL DEREGULATION LAW is
their protection to insure business viability and
maintain healthy profit margins or protection
against losses and never would this law be a
burden to those players in the oil industry.
These accounts are based on the real time
news and happenings in our country since then
and today.
Hence, after this presentation, it is earnestly
prayed that Atty. Raul Quiroz be disbarred.
A lawyer whose sworn statements are rattled with
deceit and lies like what Atty. Raul Quiroz did had
undeniably broken the Lawyers Oath, therefore
Atty. Raul Quiroz should be disbarred.

Atty Raul Quiroz, bagaman ang kumpanya ay kumikita
sa kabuuan, ito ay dumaranas ng paghihirap sa
kanyang negosyong pang refinery, dahilan sa, isa,
sa maraming dahilan, ay ang pagbaba ng buwis
sa inangkat na produktong petrolyo na dulot ng
deregulasyon ng industriya ng langis.
Sinasabi po ni Atty. Raul Quiroz ang pagbaba ng
buwis ng imported na produktong petrolyo ang
nagpapahirap sa SHELL sa kanyang refinery
business, samakatuwid ang pagbaba ng buwis
ng imported na produktong petrolyo ang
nagpapahirap sa buong refinery business ng
SHELL at hindi sa isang planta lang,
pero bakit po isang planta lamang ang isinara ng
SHELL at hindi ang buong refinery business ?
Bakit pa ang SHELL magpapatuloy ng refinery
business sa ibang planta kung patuloy itong
nasa ganoong kondisyon na nahihirapan .
Dahil sa ang pagbaba naman ng buwis ng
mga imported petroleum products na bunga ng
deregulasyon ng industriya ng langis ay naroroon
pa rin kahit na nagsarado siya ng isang planta.
Kaya nakapagtatakang handa niyang
tanggapin na magpatuloy pa sa kanyang refinery
business, sa gayong kalagayan.
Kung totoong nahihirapan di sana ay inihinto na
niya ang buong refinery business at hindi isang
planta lang at nag-import na lang siya ng
produktong petrolyo? Tama po ba ?
Your Honor, please, Yang kaganapan pong yan,
ay ihahalintulad ko sa pangyayaring si SHELL
(halimbawa lang po ng pangalan ng tao) ay
nanood ng sine. Sinabi ni SHELL sa inyo,
sa inyong kuwentuhan , na pangit ang sine at
tsika rin sa inyo na si CALTEX(halimbawa rin po
ng pangalan ng tao) ay nakita niya na lumabas
na ng sinehan . Pagkatapos, tuloy siya sa kwento
niya, na lumabas ng sinehan si CALTEX dahil raw
pangit ang sine, kahit di naman niya tinanong si
CALTEX kung anong tunay na dahilan nito sa
paglabas na ng sinehan. Tapos, tuloy uli ang
kwento niya, " Alam po ninyo dahil talaga pong
pangit ang sine kaya ang ginawa ko ay,
tinakipan ko na lang po ang isang
mata ko, at nagpatuloy sa panonood."
Maniniwala po ba kayo na totoong pangit ang sine ?
Your Honor, please, dito naman po tayo sa
paksang OIL DEREGULATION sa industriya ng
langis na sinasabi ni Atty. Raul Quiroz, na nagbibigay
sa SHELL ng financial o economic difficulties,
(kung sa anumang dahilan pa na naiisip niya)
kaya nagsarado ng lumang planta at nagbawas
ng kawani ay isang kasinungalingan.
Bagkus, ang batas na naturan ay malaking tulong
sa kanilang mga taga industriya ng langis.
Nakikita po natin na sa bawat pagtaas ng
kanilang gastusin gaya ng pagtaas ng presyo
ng krudo sa world market ay kaagad na
nakapagtataas sila ng presyo ng kanilang
produktong petrolyo. Binigyan po sila ng kalayaang
magtakda ng presyo upang masiguro ang
malaking tubo o para mabawi ang anumang
pagkalugi kung totoo man, na nararanasan nila.
Sa ibang salita ay itong batas na ito ay protection
nila upang mapangalagaan ang kanilang pakinabang
o laban sa anumang pagkalugi at di kailanman
magiging pasanin ng mga taga industriya ng
langis. Ito po ay batay sa tunay na nasasaksihan
nating mga kaganapan sa panahon ngayon.
Kaya po, Your Honor, please, wala po tayong
dapat na sayanging panahon ang mga
abogadong tulad ni Atty. Raul Quiroz na tigmak
sa kasinungalingan ay karapat dapat na alisin
na listahan ng mga abogado. Atty. Raul Quiroz
is a shame to the law profession.
Atty. Raul Quiroz should be disbarred.
